The Prosecution Attorney provides criminal prosecution services to municipal clients, handling petty misdemeanor, misdemeanor, and gross misdemeanor cases in district court, primarily in numerous Counties. This role exercises independent legal judgment, works closely with law enforcement and court personnel, and ensures fair, ethical, and effective enforcement of city and state laws.

The attorney will work within our Prosecution Group that prosecutes for 24 Minnesota cities in six different counties. We have eight prosecutors, four victim witness coordinators, two law clerks, and six administrative support staff. Our prosecution team works in a collaborative environment which allows us to deliver the best results for our clients and colleagues alike.

What You’ll Do

Essential Duties & Responsibilities

  • Prosecute petty misdemeanor, misdemeanor, and gross misdemeanor criminal offenses, including traffic and ordinance violations.
  • Review police reports, citations, and evidence to determine appropriate charges.
  • Appear in court for arraignments, pretrial hearings, motion hearings, trials, and sentencing.
  • Provide courtroom advocacy at all stages of prosecution, from arraignment through jury trial.
  • Negotiate plea agreements and case resolutions consistent with law, policy, and public safety priorities.
  • Conduct legal research and draft charging documents, pleadings, motions, and briefs.
  • Prepare and present legal arguments, examine witnesses, and introduce evidence at trial.
  • Advise law enforcement officers regarding charging decisions, legal procedures, and courtroom preparation.
  • Maintain accurate case files and records in coordination with court administration.
  • Ensure compliance with constitutional requirements, ethical obligations and prosecutorial and maintain positive relationships with client law enforcement agencies.

Is This You?

Minimum Qualifications

  • Juris Doctor (J.D.) degree from an accredited law school.
  • Admission to practice law in Minnesota and in good standing.
  • Two to ten years of criminal prosecution experience.
  • Strong knowledge of Minnesota criminal law, criminal procedure, rules of evidence, and constitutional law.

Preferred Qualifications:

  • Prior municipal prosecution experience.
  • Trial experience in misdemeanor or gross misdemeanor cases.
  • Familiarity with municipal ordinances and local court practices.
