From the most basic 7(a) loans to more complex Certified Community Development (CDC) 504 programs, we work closely with local and regional banks to administer all aspects of SBA lending. We package SBA loan documents, offer compliance reviews, assist with asset liquidations and work to resolve disputes with the SBA.
-
When existing commercial loans become troubled, we work diligently to negotiate restructured terms and agreements that best protect our client while allowing the overall transaction to remain viable.
-
In the event that a commercial lending agreement defaults, we quickly step in to protect our client’s rights and develop strategies to minimize financial loss. We have extensive experience in foreclosure and relinquishment agreements, deeds in lieu of foreclosure and enforcement of forbearance agreements.
-
From the filing of the initial notices to the expiration of the redemption period, we help clients with every facet of real estate foreclosure, while ensuring compliance with the ever-changing laws and regulations protecting the borrower. We also evaluate real estate short sale requests to help clients assess the difference between a transactional loss versus the cost of pursuing foreclosure and owning a non-earning asset.
-
Well-versed in each chapter (and every new update) of the Bankruptcy Code, our attorneys work with clients to assess their position as creditor in pending proceedings and to pursue every recovery option available.
-
At Eckberg Lammers, we recognize that transaction can break down and disputes between lenders, borrowers and other parties can reach a point where negotiation is no longer possible or advisable. In this event, we aggressively represent our clients in litigation to protect their rights and maximize financial recovery, all the while keeping their ultimate business goal in mind.
We focus specifically on:
